Your Washington Insurer Can't Drop You for a Missed Payment Right Now. That Ends September 30.

An emergency order from Washington's insurance commissioner suspends late fees, reinstatement fees, and nonpayment cancellations for property and auto policies in wildfire zip codes through September 30, 2026. The nonrenewal clause matters more than the fee waivers.

If a wildfire came anywhere near your zip code this month, your car and home insurance stopped behaving normally on August 3. It goes back to normal on September 30.

Washington’s insurance commissioner, Patty Kuderer, signed an emergency order that day covering every property and auto insurer operating in the state. In the burn zones and in every adjacent zip code, the usual rules about paying late are suspended.

You get a 45-day grace period on premium payments. Late fees are waived. Reinstatement fees are waived. And your insurer cannot cancel your policy for nonpayment unless you tell it to.

That last clause is doing a lot of work. Cancellation for nonpayment is the fastest way an insurance company gets off the hook, and right now it’s off the table.

Here’s the part the press release doesn’t lead with.

A grace period is not a discount. Every dollar you skip in August is a dollar you still owe. On October 1 the waivers expire, the clock restarts, and a policy carrying two months of unpaid premium lapses fast. Use the grace period if you need it. Just use it on purpose, with the number written down.

The sleeper provision sits further down the order, and it’s worth more than the fee waivers. Your insurer now has to give you far more warning before it walks away at renewal. For property coverage, the nonrenewal notice goes from 60 days to 120. For auto, from 20 days to 60.

Twenty days is not enough time to shop a car policy after a wildfire. Sixty is.

Nonrenewal is the real risk here, not cancellation. Kuderer said as much on a visit to Spokane, warning that the fires are likely to push more nonrenewals in wildfire-prone parts of the state. Carriers rarely cancel you mid-term. They wait for the renewal date and simply decline to offer another one.

Her description of the job is about as plain as a regulator gets: “we make sure that insurance companies follow their contract and follow the law. That’s our job.”

Do this now.

Call your carrier and get written confirmation, by email, that your zip code falls inside the order. It covers zip codes where fires burned structures and where evacuation orders were issued, plus every adjacent one. Adjacent is broad, and the person answering the phone may not know that.

Ask for the exact date your grace period ends and the exact amount due that day. Get the number, not a reassurance.

Then, if you’ve already had a nonrenewal notice or you live in a high-risk area, start shopping now rather than at renewal. That extended notice window is a head start, and a head start nobody uses is worth nothing.

The order has been running since August 3. You have about six weeks of it left, and while the commissioner’s office can extend it, nothing says it will.

Washington’s consumer line for claim help is 800-562-6900, and the commissioner’s office is running a recurring claims workshop in Spokane for fire survivors.

Six weeks of breathing room is real. It’s also six weeks.

Frequently asked questions

Which Washington zip codes does the emergency order cover?

All zip codes and adjacent zip codes in Washington where wildfires have burned homes or other structures, or where official evacuation orders have been issued. The adjacent-zip-code language is broad, so do not assume you are outside it because your own street was never threatened. Confirm your zip code with your carrier in writing.

Does the grace period mean I do not have to pay the premium?

No. It is a 45-day delay, not a discount. Late fees and reinstatement fees are waived and your policy cannot be canceled for nonpayment during the order, but the premium you skip is still owed. Ask your carrier for the exact date the grace period ends and the exact amount due that day.

What changed about nonrenewal notices?

The order extends how far in advance your insurer must tell you it will not renew you. For property coverage the notice period goes from 60 days to 120 days before the policy expires. For auto coverage it goes from 20 days to 60 days. That is extra shopping time, not protection from being dropped.

When does the order expire?

It runs from August 3 through September 30, 2026, and the commissioner's office has indicated it can be extended. Do not plan around an extension that has not been issued.
